Terms and Conditions

Please read these Terms and Conditions carefully, which are intended to regulate the purchase of products and the provision of services at the ACV - Vinhos de Talha Store, the online store of ACV - Produção e Comércio de Vinhos de Talha, Lda, headquartered at Rua Frei Amador Arrais nº9, Loja 4, 7800-491 Beja, Portugal, with VAT/Company Number 513442340, hereinafter referred to as ACV - Vinhos de Talha Store.

1. Legal Age for Purchases

By making purchases at the ACV - Vinhos de Talha Store, the user declares that they are of legal age to purchase alcoholic beverages in their country of origin and that they are not subject to any other legal restriction preventing the purchase of alcoholic beverages.

2. Accuracy and Updating of Information

ACV - Vinhos de Talha will make every effort to ensure that the products, prices, and all other content available in this online store are always accurate.

If, under any circumstance, it is not possible to provide any of the products requested by the customer, or if any information is inaccurate or outdated, whether due to human error or technical failure, ACV - Vinhos de Talha will contact the customer by email or telephone, and the customer will have the option to modify or cancel the order, receiving the respective refund if payment has already been made.

ACV - Vinhos de Talha reserves the right to change, without prior notice and at any time, all content of this online store, including products, prices, promotions, services, and commercial and usage conditions.

The images illustrating each product in the ACV - Vinhos de Talha Store may differ from the product delivered.

Any product displayed in this online store is subject to stock availability. In the event that a product ordered is out of stock, ACV - Vinhos de Talha will contact the customer, inform them of the situation, and propose alternatives. The customer may then decide to modify or cancel the order and receive the corresponding refund if payment has already been made.

Under Portuguese law, all prices displayed by the ACV - Vinhos de Talha Store include the applicable VAT rates in force.

Promotions available at the ACV - Vinhos de Talha Store may not apply to physical stores where our wines are sold.

3. Orders, Payments, and Shipping Costs

3.1 Orders

After completing an order, the customer will receive a confirmation email at the email address provided, containing details of the selected products, payments, and shipping costs. We recommend that all information be carefully checked in order to avoid errors. If you do not receive this confirmation email, or if you notice any incorrect or inaccurate information, or if you wish to make any changes, you should immediately contact ACV - Vinhos de Talha through the following contacts: (+351) 935 109 541 or comercial@vinhodetalha.pt. If the order has already been shipped, the situation will need to be reviewed by ACV - Vinhos de Talha in order to find a suitable solution.

Whenever an order cannot be fulfilled, either partially or entirely, ACV - Vinhos de Talha will contact the customer in order to find the best possible solution.

The customer may cancel the order before it has been shipped by contacting ACV - Vinhos de Talha through the following contacts: (+351) 935 109 541 or comercial@vinhodetalha.pt.

If the customer has already paid for the order and it has not yet been shipped, ACV - Vinhos de Talha will refund the full amount paid. If the customer wishes to cancel the order after it has already been shipped, the refunded amount will be deducted by the shipping and return costs, meaning 2 (two) times the shipping costs paid.

Any order will only be processed after payment has been received, except for orders with the option of collection and payment at the ACV - Vinhos de Talha Winery in Vila de Frades.

In the case of payment by bank transfer, sending proof of transfer is considered non-binding information; therefore, the order will only be processed once the transferred amount is available in ACV - Vinhos de Talha’s bank account, which generally takes between 1 and 5 business days.

All orders placed at the ACV - Vinhos de Talha Store whose payment has not been made within a maximum period of 15 days will be cancelled.

3.2 Payments

The ACV - Vinhos de Talha Store accepts the following payment methods:

  • Multibanco Reference
  • MB Way
  • PayPal
  • Bank Transfer
  • Direct payment at our winery

The currency used for payments is the Euro. Any currency conversion fees resulting from payments made in other currencies will always be borne by the customer.

3.3 Shipping Costs

Shipping costs are added to the price of each product and are calculated based on the weight of the order and its delivery destination. Customers may simulate shipping costs in the shopping cart by adding the desired products and filling in the required fields (Country, Postal Code, and Payment Method). Shipping costs are also automatically displayed at the end of the purchase process.

4. Deliveries

4.1 Estimated Transit Time for Orders

After orders are processed and shipped, delivery takes on average (estimated time):

  • Beja: same day or next day
  • Mainland Portugal: 2 business days
  • Azores and Madeira: 5 to 10 business days
  • Europe: 4 to 10 business days
  • Rest of the World: upon request

These delivery times are merely indicative and may vary due to circumstances beyond the control of ACV - Vinhos de Talha.

After the order has been shipped, the customer will receive an email containing the shipment number and a tracking link for the order. If you do not receive this email, after checking your Spam folder, you should contact ACV - Vinhos de Talha through the following contacts: (+351) 935 109 541 or (+351) 284 329 052 or geral@vinhodetalha.pt, so that the email can be resent.

4.2 Order Tracking Link

We recommend tracking your order using the link and shipment number provided in order to stay informed about the status of your order until delivery, as ACV - Vinhos de Talha does not generally notify customers of every status change in the shipment process.

4.3 How Deliveries Are Processed

Orders from the ACV - Vinhos de Talha Store are shipped through carriers, i.e., companies specialized in freight transportation.

As a rule, the carrier will only attempt delivery once at the customer’s address, so we recommend choosing a delivery address where someone is always available to receive the order. If no one is present at the time of delivery, the customer will be notified by phone and/or post regarding how to collect the order at the nearest collection point.

The carrier only delivers on business days and during working hours. It is not possible to schedule deliveries for specific dates or times, nor are deliveries made on weekends or public holidays.

4.4 Inspection of Orders Upon Arrival / Product Damage

Upon receipt, the customer must immediately inspect the products received.

If the order arrives damaged (broken), it must be returned immediately to the carrier, stating the reason for return on the carrier’s delivery note. The customer must then contact ACV - Vinhos de Talha through the following contacts: (+351) 935 109 541 or (+351) 284 329 052 or geral@vinhodetalha.pt, so that we may resolve the situation as quickly as possible.

If any anomaly is detected after delivery, the customer must immediately contact ACV - Vinhos de Talha, indicating the order number and attaching images of the packaging and items exactly as they arrived, so that we may investigate and resolve the situation as quickly as possible.

4.5 Compliance with Delivery Deadlines

For deliveries within Portugal and to other countries, ACV - Vinhos de Talha contracts transportation services with reputable and responsible companies with several years of experience in the sector. Meeting delivery deadlines is a priority; however, situations beyond the control of ACV - Vinhos de Talha may occur, resulting in delays to the indicative deadlines presented, for which ACV - Vinhos de Talha cannot be held responsible.

We recommend placing orders in advance to allow time to overcome any eventual delivery delays, especially during festive periods, when the volume of orders is generally higher.

ACV - Vinhos de Talha is not responsible for shipments to countries where local law does not permit the importation of alcoholic beverages, nor for any seizure during transit or upon arrival, or for any customs duties that may eventually be charged in the destination country.

Any customs clearance procedures or payment of such duties are the sole responsibility of the customer.

If the order is returned, ACV - Vinhos de Talha will only refund the amount paid for the products.

5. Right of Withdrawal

Under Decree-Law No. 143/2001, Article 6, revised by Decree-Law No. 82/2008 of 20 May, the customer has the right to withdraw from contracts concluded with ACV - Produção e Comércio de Vinhos de Talha, Lda., through ACV - Vinhos de Talha, and may return purchased products within 14 days and under the terms of applicable legislation, without providing any reason.

To proceed with the return of items, you must send us an email to comercial@vinhodetalha.pt, indicating the order number and invoice number, taking into account the following conditions:

  • Products must be in perfect condition and in their original packaging, under the same conditions in which they were sent, without marks or evidence of use;
  • Return shipping costs are borne by the customer;
  • In the case of defective products or incorrect shipments, ACV - Vinhos de Talha assumes responsibility for shipping and collection costs, provided that the customer informs ACV - Vinhos de Talha within a maximum period of 14 days from the date of receipt of the product.

After receipt and verification of the product at our facilities, ACV - Vinhos de Talha will refund its value through the payment method used by the customer, or through another method previously agreed upon. In the case of payments made by Multibanco Reference, refunds will be made by bank transfer to the IBAN provided by the customer.

When the return is due to manufacturing defects or raw material defects, and after receipt and verification at our facilities, we will replace the product at no cost to the customer.

Please note that when purchasing aged wines, you should bear in mind that wine is a natural product subject to bottle aging, which alters its flavors. This may not suit all consumers, even if the wine remains fit for consumption. ACV - Vinhos de Talha takes special care with the storage conditions of wines held in stock, but cannot guarantee that their evolution in the bottle will please all buyers.

Returns of used or modified products will not be accepted.

6. Electronic Complaints Book

ACV - Produção e Comércio de Vinhos de Talha, Lda., owner of this ACV - Vinhos de Talha Store, informs that, under the law, and in addition to maintaining a Complaints Book at its physical stores, it also provides an Electronic Complaints Book, which may be accessed at the website www.livroreclamacoes.pt.

The Electronic Complaints Book allows consumers and users, among other features, to submit complaints electronically, with the same legal validity as complaints submitted in physical format.

7. Applicable Law

Purchases made at the ACV - Vinhos de Talha Store are subject to Portuguese law. Any conflict or divergence in the interpretation of these Terms and Conditions of online sale shall be submitted to the competent Portuguese court.

If the customer resides outside Mainland Portugal, ACV - Vinhos de Talha informs that any legal proceedings must be brought exclusively before Portuguese courts.

These Terms and Conditions may be changed without prior notice; therefore, the customer should consult them before making any purchase.
